Motion rejected in Tyo murder

An Allegan County Judge rejected a motion to have the jury verdict against Dena “Winky” Thompson thrown out.

Judge William A. Baillargeon ruled Friday, July 11, that there was no reason to disregard the jury’s verdict, after a motion by Thompson’s attorneys.

Thompson, 38, was convicted in June of first-degree premeditated murder, conspiracy to commit first-degree murder and being an accessory after the fact to murder. The jury found that Thompson had convinced her husband, Kristofer, to murder Troy Tyo, her ex-husband, in Dec. 2007. Prosecutors claimed the murder was an attempt by Thompson to get sole custody of the couple’s children after legal efforts failed.

A trial for Scott Laverne Lathrop, of Cooper Township, who is charged as an accessory in the case, is set to begin Monday, July 21. Kristofer Thompson’s trial is set to begin Monday, Sept. 8.

Lori Ann Lathrop, of Otsego, who pleaded guilty to being an accessory after the fact, is scheduled for sentencing Friday, Aug. 15.
